GENERAL TERMS AND CONDITIONS 

§ 1 General Information Your contract partner for all orders placed through DAMMA's online offering is Damir Masic, hereinafter referred to as "DAMMA." Conflicting or deviating terms from the customer are only binding if DAMMA has explicitly accepted them in writing.

§ 2 Contract Conclusion (1) The "offers" presented on the website are non-binding invitations to the customer to place an order with DAMMA. (2) Customers can place selected or customized products into a virtual shopping cart without obligation. The contents can be viewed and modified at any time. When ready to purchase, the customer clicks "Proceed to Checkout." (3) By clicking "Buy Now," the customer submits a binding offer to conclude a contract. Before submitting, the customer has the opportunity to review and correct the order. DAMMA will send a confirmation email to acknowledge receipt but not to accept the offer. The contract is concluded when DAMMA ships the product and confirms shipping via a second email within four days. If "prepayment" is selected, the request for payment constitutes the contract acceptance within two days. (4) The contract is subject to the availability of timely and complete self-supply. In case of non-availability, the customer will be informed immediately and refunded if payment has already been made.

§ 3 Delivery/Shipping (1) Shipping is handled by a delivery service selected by DAMMA. Customers bear shipping costs, which may vary by order value and delivery location. (2) Partial deliveries are permitted under the following conditions: a) They are usable for the customer as intended, b) Remaining delivery is ensured, c) No significant additional cost or effort for the customer.

§ 4 Payment (1) Payment options include SEPA direct debit, credit card, prepayment, or other available methods. DAMMA may limit these options based on objective criteria. (2) If payment fails due to customer error, any additional costs must be covered by the customer. (3) If "invoice" is selected, DAMMA may perform a credit check with CRIF Bürgel GmbH, Munich. The credit rating is determined by mathematical-statistical methods. (4) Offset or retention rights are only permitted for undisputed or legally determined claims. (5) Customers agree to receive invoices electronically via PDF email. (6) DAMMA is exempt from VAT under German law (§19 UStG) and does not list VAT on invoices.

§ 5 Gift Cards

  • Value: Available in 25€, 50€, 100€, 150€, or 200€ amounts

  • Redemption: Only valid in the DAMMA online shop. No cash payouts or partial redemptions

  • Validity: 3 years from purchase

  • Multiple Use: Can be used across multiple orders until balance is spent

  • No return or refund

  • Remaining balance does not expire

  • DAMMA is not liable for lost/stolen/unreadable cards

  • German law applies

§ 6 Retention of Title (1) Goods remain the property of DAMMA until full payment is received. (2) Customers must treat the goods with care until ownership is transferred.

§ 7 Warranty (1) In case of defects, customers are entitled to legal rights including repair, cancellation, or price reduction. (2) For business customers, the warranty period is one year. For damage claims, statutory limits apply.

§ 8 Liability (1) DAMMA is liable: a) For intentional or gross negligence, b) For simple negligence only in case of injury or breach of essential contract obligations. In such cases, liability is limited to foreseeable damage. c) DAMMA is not liable beyond this unless legally required, or in cases of concealed defects or guaranteed qualities. (2) These liability limits also apply to DAMMA representatives and employees.

§ 9 Right of Withdrawal (for EU Consumers) You have the right to withdraw from this contract within 14 days without stating reasons. The period starts from the day you or a third party (excluding the carrier) received the last item. To exercise your right, inform us (DAMMA, info@damma.online) via a clear statement (e.g., email or letter). To meet the deadline, it is enough to send notice before the period ends.

Effects of Withdrawal: If you withdraw, we will refund all payments, including standard delivery costs, within 14 days. Refunds use the same payment method unless agreed otherwise. We may delay refunds until the goods are returned or proof of return is provided. You must return items within 14 days of informing us. You bear return shipping costs. You are liable for any diminished value from unnecessary handling.

Exclusions: No right of withdrawal for customized or personalized items.
