§ 1 Scope of Application These Terms of Use apply to all visitors and users of the website www.damma.online (hereinafter referred to as "Website"), operated by [Your Name/Company], hereinafter "we" or "DAMMA."

§ 2 Content and Offerings All content, designs, texts, and products on this site serve the purpose of presenting, informing, and selling DAMMA products. These contents are protected by copyright and may not be used without written permission.

§ 3 Orders and Purchase Conditions The products offered on the website are produced only after an order is placed (print-on-demand). That means:

  • No overproduction,

  • Resource-conscious practices,

  • A little more patience for delivery. We use the nearest production site to reduce transportation distances. Every purchase is a conscious choice for sustainability.

§ 4 Registration and Newsletter Certain offerings, like receiving a discount code, may require registration. The data collected will be handled confidentially in accordance with our [Privacy Policy].

§ 5 Design Rights All DAMMA designs are the property of DAMMA and may not be copied, altered, or otherwise used commercially – not even in other galaxies.

§ 6 Website Availability We strive to keep the website accessible at all times. If it does go on strike – no panic. Maybe it’s meditating on world peace.

§ 7 Changes DAMMA reserves the right to change these Terms of Use at any time. The version valid at the time of your visit shall apply.

§ 8 Liability We accept no liability for third-party content accessible via links. Nor for damages that may arise from using the website – except in cases of gross negligence.

§ 9 Applicable Law The law of the Federal Republic of Germany applies. The place of jurisdiction is – depending on the legal structure – the registered office of the operator.

TERMS OF USE
FOR CUSTOM DESIGN

§ 1 Scope These General Terms and Conditions (GTC) apply to all contracts between DAMMA Studio (hereinafter "Provider") and customers (hereinafter "Customer") in connection with the creation of custom designs. By commissioning a design, the Customer agrees to these GTC.

§ 2 Scope of Services The Provider creates individual design drafts upon request from the Customer. One design is created per order. No revision rounds are offered. After completion, the design will be made available for purchase in the Provider’s online shop. The custom design is free of charge.

§ 3 Design Process The Customer fills out a questionnaire to guide the design process. Upon receipt of the questionnaire, the Provider starts developing the draft. The draft is then submitted to the Customer for approval. After approval, the Customer may only use the design in connection with a purchase of a t-shirt, hoodie, or another personalized product.

§ 4 Prices and Payment The custom design is created free of charge. No additional costs are incurred for the design itself. However, payment for the selected product (e.g., t-shirt, hoodie, or other personalized item) is required and invoiced separately.

§ 5 Delivery and Usage The final design is made available to the Customer only in connection with an order of physical products (e.g., t-shirts, hoodies, or other personalized items). The Customer does not acquire independent usage rights to the design.

§ 6 Copyright and Usage Rights The Provider retains all copyright to the created designs. The Customer may not use the design separately from a personalized product supplied by the Provider. Independent use, resale, or reproduction of the design is not permitted without the Provider’s consent.

§ 7 Returns and Right of Withdrawal As the designs are made according to the Customer's specifications, no right of withdrawal exists pursuant to Section 312g (2) No. 1 of the German Civil Code (BGB).

§ 8 Liability The Provider is liable only for intent and gross negligence. For simple negligence, liability only applies to breaches of essential contractual obligations. The Provider accepts no liability for losses or damages resulting from improper use of the designs.

§ 9 Confidentiality All information provided by the Customer during the design process will be treated as confidential and will not be shared with third parties.

§ 10 Final Provisions The law of the Federal Republic of Germany applies. The place of jurisdiction for all disputes arising from this contract is the location of the Provider. If any provision of these GTC is found to be invalid, the validity of the remaining provisions shall not be affected.
