TERMS. THE AGREEMENT.
These Terms describe the conditions for using DAMMA.ONLINE and purchasing digital works through the website. Mandatory consumer rights remain unaffected.
What these Terms apply to.
These Terms apply to the use of DAMMA.ONLINE and to contracts concerning digital content offered through the website, unless otherwise expressly stated.
The contracting party is:
Damir Masic
DAMMA.ONLINE
P.O.BOX 4131
40645 Meerbusch
Germany
Email: info@damma.online
Further provider information is available in the Imprint .
Digital works.
DAMMA.ONLINE offers digital creative works, including e-books and other downloadable content.
The description on the relevant product page forms part of the information concerning that product.
File format, content, technical characteristics and any stated compatibility requirements are described on the respective product page.
The customer is responsible for using a device and software capable of opening the stated file formats.
Unless expressly stated otherwise, no physical data carrier is supplied.
Unless expressly stated otherwise, purchases are one-time purchases and do not create a recurring subscription.
Order and contract formation.
The presentation of digital content on DAMMA.ONLINE does not by itself constitute a binding contractual offer.
During checkout, the customer can review the selected product, price and information entered and use the available checkout controls to correct input errors before submitting the order.
By submitting the order using the final payment-order control, the customer makes a binding offer to conclude the contract.
The contract is concluded when the order is accepted through the checkout system, normally by electronic order confirmation or by making the purchased digital content available, whichever occurs first.
The customer receives an electronic confirmation of the order. Customers should retain the confirmation and these Terms for their records.
DAMMA.ONLINE does not promise permanent online access to the complete contract text after conclusion of the contract unless such access is expressly provided.
The language available for contracts through DAMMA.ONLINE is English.
Prices and payment.
The price displayed for the relevant product when the order is submitted applies.
Unless another currency is expressly shown, prices are stated in euros (EUR).
The final amount payable is displayed before the customer submits the order. Applicable taxes and other mandatory price components are included or displayed as required by applicable law.
No shipping costs apply to products supplied exclusively as digital downloads.
Payment is processed using the payment methods made available during checkout. DAMMA.ONLINE currently uses Squarespace Payments for its checkout and payment infrastructure.
Available payment methods may vary depending on country, device and checkout configuration. The methods displayed during checkout are decisive.
Digital delivery.
Digital products are normally made available electronically after successful payment.
Delivery may take place through the order confirmation page, a download email or another electronic method made available by the website platform.
Download links may be time-limited. If a download link provided through the platform has expired, a renewed link may be issued to the email address used for the original order.
Customers are responsible for providing a valid email address during checkout. If an expected delivery email is not received, the customer should also check spam or junk folders.
If paid digital content cannot be accessed, contact info@damma.online and identify the relevant order.
Digital content and withdrawal rights.
Consumers generally have a statutory right to withdraw from a distance contract within fourteen days without giving a reason.
For digital content that is not supplied on a physical medium, the withdrawal period generally begins when the contract is concluded.
For paid digital content, the withdrawal right may expire before the end of the fourteen-day period only if the statutory requirements for early expiry are satisfied.
In particular, before performance begins, the consumer must expressly agree that performance may begin before the end of the withdrawal period and must acknowledge that the withdrawal right is lost when performance begins.
The required consent and acknowledgement must be provided separately where required by law and must be reflected in the contractual confirmation on a durable medium.
Merely accepting these Terms does not replace a legally required separate express consent and acknowledgement concerning immediate supply of paid digital content.
Where the statutory withdrawal right still exists, the consumer may exercise it by making a clear statement of the decision to withdraw. No reason is required.
A withdrawal statement may be sent to:
DAMMA.ONLINE
Email:
info@damma.online
Sending the withdrawal declaration before expiry of the withdrawal period is sufficient to meet the deadline.
Where German law requires an electronic withdrawal function for a contract concluded through an online interface, the statutory requirements concerning that function apply in addition to the options described above.
Statutory rights remain.
Statutory rights concerning digital products remain unaffected by these Terms.
Digital content must comply with the applicable contractual and statutory requirements.
If digital content is defective, unavailable or otherwise does not conform to the contract, consumers retain the remedies available to them under applicable law.
Nothing in these Terms excludes or limits mandatory rights under Sections 327 et seq. of the German Civil Code (BGB) where those provisions apply.
Personal use.
Unless a product page expressly grants broader rights, purchasing a digital work grants the customer a non-exclusive, non-transferable right to download, store and use the work for personal purposes.
Reasonable personal backup copies may be made.
Purchasing a digital file does not transfer copyright or ownership of the intellectual property contained in the work.
Redistribution, resale, public uploading, file sharing, commercial reproduction or making the files available to third parties is not permitted unless authorized by law or by the respective rights holder.
The website may change.
DAMMA.ONLINE may update, reorganize, modify or remove website content and functionality where reasonably necessary.
Permanent uninterrupted availability of the website cannot be guaranteed.
Changes to the website do not remove contractual or statutory rights already acquired in relation to purchased digital content.
The record is not public property.
Texts, books, music, images, graphics and other original materials published through DAMMA.ONLINE are protected by applicable intellectual property law.
Public availability on the website does not mean that a work is free of copyright or other intellectual property rights.
Content may only be reproduced, distributed, modified or otherwise used beyond statutory permissions with authorization from the respective rights holder.
Legal responsibility.
Liability is governed by applicable statutory law.
Nothing in these Terms is intended to exclude or limit liability where liability cannot legally be excluded or limited.
Mandatory consumer protection rights remain unaffected.
Applicable law.
German law applies to the extent legally permissible.
If the customer is a consumer, mandatory consumer protection provisions of the country in which the consumer habitually resides remain unaffected where applicable.
Changes to these Terms.
These Terms may be updated for future use when products, services, technical systems or legal requirements change.
Changes do not retroactively alter contracts already concluded unless the parties agree otherwise or applicable law provides otherwise.
The version applicable when an order is placed governs that order.
